Regulatory Committee/ARB Combined Meeting

          December 12, 2007

 

Present:            Charles Kayser (Regulatory Committee Chairperson), Roger Gibbons, Dorrie Kayser, Jean Scott, Ken Westcott, Marilyn Dotto and Curt Goodrich

 

The meeting was called to order at 5:30 PM in the Equestrian Center Lounge.

 

ARB

 

          OLD BUSINESS:

                   - The fence around the Wilkins’ Pool is now installed

 

            NEW BUSINESS:

                        - The Auster’s proposal for new construction of a residence on lots 371/372 was carefully reviewed and not recommended for approval as submitted because the garage shown on the plans does not comply with the Covenants.

 

                        - The Mosely-Tanner request to construct a manure bin was reviewed and recommended for approval as submitted.

 

            OTHER:

                        - A motion was passed that all ARB recommendation letters (approval or denial) for construction on mini-farm lots should contain a reminder that any equine housing/barns considered for current or future construction must match or be close to the colors used in the residence and must be submitted to the ARB for approval.

 

 

REGULATORY

 

A motion was made to approve last month’s minutes. The motion was seconded and the minutes were approved and signed.

 

OLD BUSINESS

 

- The Wiese’s have been in contact with the McLendon Hills office and resolution of this issue is still pending.  Should it be decided that the lot will be returned to its original condition, the committee agrees that “original condition” means that the existing construction be completely removed and not buried on the lot.

 

- The Lake Rules revisions were presented to the committee and two clarifications were proposed. It was agreed that those changes would be made and the revised Lake Rules would then be presented to the Transition Board for approval.

 

- A motion was made and passed to recommend amending verbiage in the Covenants under Article V, Section 3, Article IV, Section 11, and Article IV, Section 16.  The Chairperson will maintain a list of recommended Covenant changes and interpretations.

 

- The Committee passed a motion to recommend that the Front Gates be adjusted to close an hour earlier (5:00PM), at dark, during the winter months.

 

- The Committee received the name and number of a person in the Moore County Fire Marshall’s office who would be willing to conduct barn safety programs and barn inspections for mini-farm owners.

 

- An update was presented on the information provided by independent legal counsel thus far.  A meeting will need to take place to determine how to proceed from this point considering the limited funds available.

 

A motion to adjourn was made and seconded. The meeting was adjourned at 7:40PM.

 

The next meeting of the ARB will be on Wednesday, January 9, 2007 at 5:30PM in the Equestrian Center Lounge.
